Aggressive Drug Crimes Defense
Using investigators who are former police officers, we will investigate the circumstances of your arrest. We will determine whether there was probable cause to stop you and whether the search and seizure was legal. We will also investigate any drug test you were given and may challenge the results. If the police violated your constitutional rights, we can argue for reduced or dismissed charges.
The revised Rockefeller Drug Law sentencing guidelines allow for more flexibility in handling cases involving non-violent offenders. If your crime was caused by drug addiction, we can seek options such as diversionary programs, drug court or SHOCK incarceration. In many cases, a disposition can be worked out with a rehabilitation program that does not require jail or prison time.
Penalties for Conviction
The amount of marijuana you are accused of possession is largely what determines the charge and penalties you will face. The differences between penalties for possession and possession with no intent to distribute are significant. Prior drug convictions are also a consideration.
If you are convicted of a federal marijuana crime, you may face the following penalties for a first offense:
•    A prison term of 5 years or less for 50 Kilograms or less of marijuana or one to 49 marijuana plants
•    A 5 to 40 year prison term for 100 kilograms or more of marijuana or 100 to 999 marijuana plants
•    A prison term of 10 years to life for 1,000 kilograms or more of a mixture or substance containing marijuana or 1,000 or more marijuana plants
People with prior federal drug convictions will face penalties of up to life in prison. If you are sentenced to prison in a federal drug crime, you must serve a minimum of 85% of your sentence. You will also face harsh fines, ranging from $250,000 to $4 million.
